National Code of Civil and Family Procedures — Entry into force in CDMX as of December 2024

On August 26, 2024, it was published in the Official Gazette of the Federation The”Agreement issuing the Declaration of Validity of the National Code of Civil and Family Procedures in Mexico City, derived from the request made by the Chief Judge of the Superior Court of Justice and the Judicial Council of the Judiciary of the Judiciary of Mexico City” As of December 1, 2024, the National Code of Civil and Family Procedures (hereinafter, the “CNPCF”) will enter into force in Mexico City, initially applying to certain procedures, which are detailed below. Procedures not included in this first phase will take effect in a phased manner at later dates.

I. What procedures will be governed by the CNPCF starting in December 2024 in Mexico City?

A. Civil Matters

In civil matters, the procedures to be governed by the CNPCF are:

  1. Special Oral Mortgage Judgment.
  2. Special Oral Real Estate Leasing Trial.
  3. Preparatory procedures, resources and means of defense provided for in the CNPCF.

B. Family Matter

In family matters, the procedures that will be governed by the CNPCF are:

  1. Voluntary Jurisdiction Procedures.
  2. Family disputes in which divorce is not considered.
  3. Conflicts addressed through restorative justice.
  4. Preparatory procedures, resources and means of defense provided for in the CNPCF.

II. A momentous change in civil and family processes

The entry into force of the CNPCF marks the beginning of a significant change in civil and family procedures in Mexico. This new regulatory framework aims to unify procedures at the national level, prioritizing orality, digital justice and procedural efficiency.

With these reforms, lawsuits will be more agile and digital, implying both opportunities and challenges for litigants and users of the justice system.
