Spanish Nationality by Grandchildren's Law

We are pleased to inform you that the Council of Ministers officially approved, on July 9, 2024, the extension of the deadline for applying for Spanish Nationality through the Democratic Memory Act, better known as the “Grandchildren's Law”. This legal extension extends the deadline Until the end of October 2025, providing an additional opportunity for those who wish to obtain Spanish Nationality.

 

Therefore, the two-year period provided for in that section for the exercise of the right to apply for Spanish nationality is extended for a third year, since this additional provision recognizes those born outside of Spain to a father or mother, grandfather or grandmother, who were originally Spanish, and who, as a result of having undergone exile for political, ideological or belief or sexual orientation and identity, have lost or renounced Spanish nationality.

 

Therefore, all those who are in the following cases may apply for Spanish nationality through this law:

 

· They were born outside of Spain to a father/mother, grandfather/grandmother, who were originally Spanish. It is not necessary to prove that they emigrated in a specific period, nor does it affect the country where they settled.

· They were born outside of Spain to a father/mother, grandfather/grandmother, who were originally Spanish and who, as a result of having been in exile for political, ideological, decency or sexual orientation and identity, had lost or renounced their Spanish Nationality.

· They are sons/daughters of Spanish women who lost their nationality because they married foreigners before the entry into force of the Spanish Constitution (28/12/1978).

· They are sons/daughters who could not be naturalized as Spaniards because they were of legal age at the time when the Spanish father or mother obtained the Spanish Nationality of origin by the Historical Memory Act (Law 52/2007).

· Any child of Spanish parents who obtained Spanish Nationality of origin through the previous Historical Memory Act (Law 52/2007).

· They obtained Spanish Nationality by option as sons/daughters of parents who were originally Spanish (Law 36/2002).
